1. Terms of Use
By using this website to purchase products from Agix, LDA, headquartered at Rua da Floresta 800, Azambucho-Pousos, Portugal, with tax identification number 513256180, you acknowledge that you understand and agree to comply with the provisions set out herein ("General Terms of Sale"). These General Terms of Sale apply to purchases from Agix made through the website and constitute a contract between you and Agix. They are incorporated into any quote, order, confirmation, invoice, or other communication sent or received from Agix. We reserve the right to amend these Terms and Conditions periodically, for any reason, and without separate prior notice. The version of the terms and conditions in effect at the time of an individual purchase will apply to that purchase. Any purchase notes you may have in place are explicitly excluded.
2. Export Control and Sanctions Regulations
By placing an order, the customer acknowledges and understands that the items purchased are subject to European Union export control and sanctions regulations, and agrees to comply with all such regulations. The customer further confirms that, according to Agix’s policy, the purchased items may not be exported outside the European Union and are solely intended for the customer's use.
3. Orders and Shipping
Agix will use commercially reasonable efforts to meet the delivery deadlines stated herein but does not guarantee this in all instances. Unless explicitly stated otherwise by Agix, delivery timelines are indicative only, and the customer confirms that the delivery date is not an essential element of the purchase. Except in cases of gross negligence, fraud, or wilful misconduct, Agix shall not be liable for any delay or its consequences. Agix reserves the right to make partial deliveries and will choose the carrier at its sole discretion.
Agix is not bound by any order until it has been accepted by Agix. Agix may accept or reject any order at its discretion and will notify you of such acceptance or rejection.
The risk of loss or damage to goods transfers to the customer upon shipment.
4. Price and Payment
Unless explicitly stated otherwise, all prices exclude transport costs, VAT, taxes, and other charges, which shall always be borne by the customer.
Despite our best efforts, a product on our website may occasionally be displayed with an incorrect price. In such cases, Agix reserves the right to cancel the order, even after it has been accepted.
Agix expressly retains all rights to any products supplied until full payment, including interest and any additional costs, has been made. Ownership rights will not transfer to the customer until full payment is completed.
5. Returns and Refunds
To return your order to Agix, you must first obtain a return authorisation. This can be requested via our customer support at support@agix.pt.
Products are custom produced and configured for each order by default. Therefore, except in cases of manufacturing or performance defects, returns are not possible.
Agix is under no obligation to accept a return request and may decide at its sole discretion whether to grant a return authorisation. Products must be returned in new condition, in their original packaging, and free from wear, damage, misuse, or alterations. Failure to meet these conditions may result in the rejection of your return request.
6. Backorders
If your order includes both available and out-of-stock items, they will be shipped separately. Available items will be dispatched per the “Orders and Shipping” section, and backordered items as they become available. International orders containing backordered items may be held until all items are available. We will make reasonable efforts to provide accurate wait time estimates. You will be charged for backordered items upon receipt by Agix, but you may cancel at any time before shipping and receive a full refund.
7. Order Discrepancies
It is your responsibility to inspect all products upon receipt to ensure they match your order in terms of conformity, quantity, and quality. Claims regarding order discrepancies must be submitted in writing within seven (7) days of receipt. Products must be made available for inspection by Agix, and all necessary and reasonable steps must be taken to prevent and minimise damage. Use or conversion of the products constitutes irrevocable acceptance.
Claims for hidden defects are only valid if reported in writing within seven (7) days of discovery and provided that (i) the products remain available for Agix’s inspection and (ii) all reasonable steps are taken to avoid and limit damages.
Discrepancy claims must be sent via email to support@agix.pt.
In any case, claims for non-conformity or product defects are subject to a one (1) year limitation period from the delivery date.
You may not use a complaint to delay or withhold payment, nor cancel the order or delivery.
8. Deliveries
Depending on the shipping method, a signature may be required upon delivery. If you request delivery without a signature, Agix is not liable for any damage or loss of the package.
If your chosen carrier fails to deliver on time or loses the order, we will file a claim on your behalf, but we will not be responsible for the loss.
9. Proper Use
It is your responsibility to use all products responsibly, in line with their intended purpose and any instructions or manuals provided by Agix. Agix is not liable for damages resulting from improper or hazardous use, including use beyond normal lifespan, tampering, improper storage, handling, transport, installation, or use against instructions, or lack of maintenance.
Once delivered, you are solely responsible for the correct installation, use, storage, and maintenance of the products. All related costs are your responsibility.
10. Specifications and Quality Deviations
Agix only guarantees that products meet the basic specifications as communicated in technical or contractual documents or as reasonably expected.
Minor deviations in colour, composition, shape, design, weight, or condition do not constitute a discrepancy.
Any additional data sheets or marketing materials provided are for informational purposes only and do not imply additional specifications or obligations.
All recommendations or statements by Agix regarding product performance are based on experience and research but do not constitute warranties. You are responsible for assessing product suitability through your own testing. Agix does not guarantee suitability for your intended use.
11. Warranties
If a product is found to have a material or manufacturing defect, you may request a replacement in accordance with the “Order Discrepancies” section. Agix will replace defective products only if defects arise under normal and proper use. This warranty does not cover faults caused by misuse, negligence, modification, or repair by unauthorised personnel.
Except as explicitly stated and subject to applicable law, Agix disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
12. Limitation of Liability
To the fullest extent permitted by law, Agix shall not be liable for indirect, incidental, or consequential damages including (but not limited to) loss of profits, revenue, income, production limitations, overhead increases, loss of clientele, or third-party claims.
Agix's liability is limited to the purchase price of the products in question.
Your sole and exclusive remedy for any order discrepancy or defective product is replacement of the item, without further compensation.
Nothing in these terms shall exclude liability that cannot be excluded under applicable law.
13. Website Accuracy and Disclaimer
We make reasonable efforts to ensure all information on this website is accurate, but reserve the right to correct errors and update information at any time. Use of the website and its content is at your own risk. All information is provided “as is” and “as available.” Agix does not warrant completeness, security, reliability, quality, accuracy, or availability. Agix and its staff, agents, and directors shall not be liable for damages arising from the use or inability to use the website or its linked content. We are not responsible for any virus or malicious software that may affect your systems.
14. Intellectual Property
All visual marketing material on this website belongs to Agix and is protected by intellectual property rights, including copyright, trademarks, trade names, logos, inventions, trade secrets, patents, software, and related privileges.
You confirm that all intellectual property rights on this site remain the property of Agix. These terms do not grant any rights or licences except as explicitly stated. You agree not to copy, modify, distribute, or commercially exploit any site content. All non-granted rights remain reserved by Agix.
Agix grants you a non-exclusive, non-transferable, non-sublicensable, and non-assignable right to use the site’s intellectual property solely to access and order through the site in accordance with these terms.

Hyperlinks to this site from other websites do not imply a relationship between Agix and those operators, and we disclaim responsibility for third-party sites. Hyperlinks provided here are for convenience only and we accept no liability for their content or use.
16. Force Majeure
Force majeure includes events or conditions making fulfilment of obligations impossible, impractical, or unsafe, such as natural disasters, fires, strikes, war, terrorism, civil unrest, epidemics (including pandemics), technical failures, or government actions. Force majeure affecting Agix’s suppliers or affiliates shall also constitute force majeure for Agix.
In such cases, Agix’s obligations are suspended, and timelines are extended accordingly. Agix will notify the customer and both parties will make reasonable efforts to minimise impacts.
17. Jurisdiction and Governing Law
These terms and all transactions are governed by Portuguese law. No other foreign or international laws shall apply. Any dispute shall be submitted exclusively to Portuguese-speaking courts, jurisdiction of Leiria.
18. Standard 1-Year Warranty
All Agix products – equipment, mats, accessories – include a 1-year full warranty covering the entire machine, including any associated robots.
